This disclaimer applies to all services provided by Rebecca Todd an accredited Family Dispute Resolution Practitioner (FDRP) in Victoria. By participating in Family Dispute Resolution (FDR), all parties acknowledge and agree to the terms outlined below.

 

Nature of Mediation Services

FDR is a confidential, impartial, and voluntary process aimed at assisting parties in resolving family disputes.

The practitioner does not provide legal advice, financial advice, or psychological counselling. Parties are encouraged to seek independent professional advice as needed.

While mediation seeks to promote fair and practical agreements, participation does not guarantee a resolution.

 

Confidentiality & Exceptions

Discussions during mediation are confidential and cannot be used as evidence in court, except as required by law.

Exceptions to confidentiality include situations where there is a risk of harm to a person, child abuse, family violence, or criminal activity, in which case the practitioner may be legally required to report to relevant authorities.

 

Voluntary Participation & Good Faith

Participation in FDR is voluntary, and parties may withdraw at any time.

Parties are expected to engage in discussions respectfully and in good faith to work towards a resolution.

 

Legal Enforceability of Agreements

Any agreement reached through mediation is not legally binding unless formalized into a Parenting Plan or Consent Orders,  

 

Binding Financial Agreement.

Parties should seek legal advice before signing any documents.

The FDR practitioner is not responsible for enforcing any agreement made during mediation.

 

Practitioner’s Role & Impartiality

The FDR practitioner acts as a neutral facilitator and does not take sides or make decisions for the parties.

If any conflict of interest arises, the practitioner reserves the right to withdraw from the mediation process.

 

Limitation of Liability

The practitioner is not liable for any loss, damages, or consequences resulting from participation in mediation, reliance on discussions, or agreements made during the process.

Parties participate at their own discretion and are responsible for their own decisions and outcomes.

 

Complaints & Feedback

Any concerns about the mediation process can be addressed through the FDR Practitioner’s internal complaints process.

If unresolved, parties may contact the Attorney-General’s Department or relevant regulatory bodies.

 

By proceeding with mediation, all parties will be asked to acknowledge that they have read, understood, and agreed to the terms of this disclaimer.

Privacy:

Family Dispute Resolution (FDR) is a confidential process, ensuring that discussions remain private and cannot be used as evidence in court, except in specific legal circumstances.

Peaceful Resolution Family Mediation is dedicated to delivering high-quality services. This policy details our commitment to managing your personal information responsibly and securely.

 

Confidentiality in FDR

Protected Discussions – Information shared during mediation cannot be disclosed outside the process unless required by law.

Exceptions – Confidentiality may be waived if there is a risk of harm, child abuse, family violence, or criminal activity, as practitioners have mandatory reporting obligations.

Without Prejudice – Offers or concessions made during FDR cannot be used against a party in legal proceedings.

Storage of Confidential Information

Secure Record-Keeping – Notes, agreements, and any personal information are stored in locked physical files or encrypted digital systems.

Limited Access – Only the Family Dispute Resolution Practitioner (FDRP) and authorized personnel (if applicable) can access case records.

Data Retention & Disposal – Records are kept for the legally required period before being securely destroyed or deleted to protect privacy.

These measures ensure that parties can engage in FDR openly and honestly, knowing their information is protected.

A side note

My fees are estimates only  – your matter might cost more or less depending on your unique circumstances.

Being an FDRP is just one part of what I do. My fees cover more than just mediation sessions—they also include administrative time, detailed note-taking, drafting parenting plans, follow-up calls and emails, and sourcing referrals when needed. In other words, my work continues well beyond our session.

As a solo practitioner, I am fully present with you and committed to ongoing professional development to provide the highest quality service. My rates are reviewed annually, and if you are experiencing financial hardship, I am open to discussing a payment plan.
